XSplit is super user-friendly, it's got many powerful plugins for easy streaming, and it plays nice with lots of platforms. Yeah, it's a bit pricey, but if you're all about streaming, it's money well spent.

US guy here (not a lawyer), definitely set up the company first and have written stuff in place for what each founder/dev gets. Team disagreements over a multi-sig or distribution can be a killer and are likely going to be your main issue.
