The solution really depends on what sort of problems you are trying to solve and who your customers are. It doesn't seem that severe tbh. They payed quite some cash for him to come work for them at exercise.com, another website they were developing at the time and he dropped out after 9 months to work full-time on Lichess. Some grudges were held but this was not about either website and it was a long time ago. Source: over 4 years ago
In short: Erik Allebest hired me to work on exercise.com, after I had started working on Lichess. I never had access to any code or intel from chess.com. I left exercise.com to work for startups unrelated to chess for 6 years, before Lichess hired me as full-time dev. Source: over 5 years ago
