We can also confirm the photo was on the website as soon as it was re-launched as textures.com in 2016. All of the other images on the website appeared at that time, it was not that single image being uploaded. Source: 5 months ago
Also, I didn't see it mentioned, but if it's environments that you are mostly after, one possible solution is to use HDRIs for the background. Obviously those are more limiting than a proper 3D environment but might be good if you are just doing static, one-off shots. As for rule 2 compliance, you may recall from the last post, I textured the duck with an image from unsplash. I used a terrain texture from polyhaven.com (was texturehaven.com back when I downloaded it.) I honestly cannot remember which tool I got the heightmap from, it was so long ago.
