The servers were volunteer hosted under no binding agreement, staff were volunteers who never signed any contracts (christel was the only paid person). "freenode" the informal organization existed LONG before "freenode limited" the legal corporation. It would be very VERY hard for "freenode limited" to claim freenode's name as a trademark.
