US guy here (not a lawyer), definitely set up the company first and have written stuff in place for what each founder/dev gets. Team disagreements over a multi-sig or distribution can be a killer and are likely going to be your main issue. I've used https://getterms.io for my project https://disknotifier.com. Paid around $50, have a look! I truly believe minor tweaks is all that is required to such a boilerplate document.
